The Retail Producer Path to Binding New Business
E&S in plain language.
Excess and surplus lines (E&S) insurance provides coverage for risks that may not fit the standard, admitted insurance market. Coverage is placed through a licensed excess line broker with an eligible nonadmitted insurer. E&S placements have additional disclosure, tax, and filing requirements and generally do not have state guaranty-fund protection. NAIC overview
Who does what.
The retail producer manages the insured relationship and submission. Risk Theory Insurance Services (RTIS) acts as the placing wholesaler and excess line broker. Jupiter Risk Services (JRS) reviews and binds the risk under authority from Amherst Specialty Insurance Company, the insurer. RHE supports the transaction, signatures, document preparation, and delivery.
-
Review the quote and total cost.
The retail producer works with the insured to confirm the proposed coverage, limits, effective date, and underwriting requirements. Review the full cost—including premium, applicable insurer charges, the RTIS broker fee, excess-line tax, and stamping fee—so the insured understands both coverage and price before proceeding.
-
Complete the required acknowledgments and signatures.
The insured signs the application and Broker Fee Authorization through the established signing process. In the updated retail bind flow, the insured’s electronic bind signature also signs NELP+: the Notice of Excess Lines Placement and Total Cost Form. This explains the E&S placement and associated costs. The signer must be an actual person, including when signing for a business entity.
The producer also completes Part C, the producing broker’s due-diligence affidavit. An authorized agency user may submit on that person’s behalf with an explicit authorization affirmation. This is separate from the insured’s signature.
-
Submit the bind request.
The producer selects Bind and completes the required review. JRS reviews and binds the risk under its Amherst authority. A quote or an incomplete bind request is not confirmation that coverage is in force.
-
Receive evidence of coverage.
The retail producer receives the RTIS Acknowledgment Package, containing:
- RTIS Confirmation of Coverage
- RTIS Quote / Policy Summary
- Broker Fee Authorization
- RTIS Accounting Statement
Signed NELP+ is delivered separately. The Confirmation of Coverage provides evidence of bound coverage while the formal policy awaits stamping. The unstamped policy and JRS Proof of Binding remain internal.
-
Receive the final policy after stamping.
RTIS Compliance handles the filing with the Excess Line Association of New York (ELANY), supported by Roundhill’s documents and information. Once stamping is complete, Roundhill assembles and sends the final policy package to the retail producer. Coverage is in force while this filing and delivery process is completed.
